আইনি স্বীকৃতি দিল সুপ্রিম কোর্ট । বৃহস্পতিবার এমনই এক ঐতিহাসিক রায় দিল দেশের শীর্ষ
আদালত । আর পাঁচটা পেশার মতই যৌন পেশাকেও সমমর্যাদা দিতে হবে বলে সাফ জানিয়ে দিলেন বিচারপতিরা
। পাশাপাশি এই কর্মে স্বেচ্ছায়
আসা কর্মীদের কাজে অকারনে কোনও পুলিশি হস্তক্ষেপ কিংবা ফৌজদারি
মামলা দায়ের করা যাবে না ।
তাঁদের কথায় যৌনপেশায় বলপূর্বক নিয়ে আসাই বেআইনি । যৌনপেশা বেআইনি নয় ।
এদিন এই মামলার প্রধান বিচারপতি এল নাগেশ্বর রাও সহ তিন বিচারপতির ডিভিশন বেঞ্চ নির্দেশিকা জারি করে । ফলে যৌনকর্মীদের অধিকার সুরক্ষিত থাকবে বলে মনে করা হচ্ছে। বিচারপতিদের কথা অনুযায়ী যৌনকর্মীরাও আইনের চোখে সমান সুরক্ষার অধিকারী । যখন স্পষ্ট হয়ে গিয়েছে যে, একজন যৌনকর্মী প্রাপ্তবয়স্ক এবং তিনি সম্মতি সাপেক্ষেই যৌনতা বিক্রি করছেন, তখন পুলিশকে অকারন হস্তক্ষেপ থেকে বিরত থাকতে হবে। কোনও ফৌজদারি ব্যাবস্থাও গ্রহন করা যাবেনা। সংবিধানে ২১ নম্বর অনুচ্ছেদ এই দেশের প্রত্যেক নাগরিকের মর্যাদাপূর্ণ জীবনযাপনের অধিকার সুনিশ্চিত করেছে , বলে জানিয়েছেন বিচারপতিরা ।
নির্দেশিকায় আরও বলা হয়েছে , যৌনপল্লিতে পুলিশি অভিযানে কোনও যৌনকর্মীকে হেনস্থা করা যাবে না । মা যৌনপেশায় আছে বলে শুধু সেই কারনেই তার সন্তানকে তাঁর থেকে দূরে সরিয়ে নিয়ে যাওয়া বা তার সন্তানের অধিকার ছিনিয়ে নেওয়া যাবে না। যদি কোনও যৌনকর্মী যৌন হেনস্থার অভিযোগ নিয়ে আসেন তাহলে গোটা বিষয়টি খতিয়ে দেখে সঠিক ব্যবস্থা নিতে হবে একজন সাধারণ নাগরিকের মতোই । একই সঙ্গে যৌনকর্মীর পরিচয় যাতে প্রকাশ্যে না আসে সে দিকেও লক্ষ্য রাখতে হবে। মনে রাখতে হবে, যৌনকর্ম আইনত অপরাধ নয় । তাই একজন সাধারন মানুষের মতোই তাদেরও সমস্ত সুবিধা পাওয়ার অধিকার আছে।
সুপ্রিম কোর্টের পরবর্তী শুনানি ২৭ জুলাই , তাই এই বিষয়ে কেন্দ্রের মতামতও জানতে চেয়েছে শীর্ষ আদালত ।
